11. NO RESALE OF SERVICE

Any breach and/or infringement to that clause shall be subject to indemnification according to clause (10).

Further, you agree that all terminations for cause mentioned in the TOS shall be made in SETUPFAMILY.COM's sole discretion and that SETUPFAMILY.COM shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service.

15. DEALINGS WITH ADVERTISERS

B. SETUPFAMILY.COM AND ITS AFFILIATES, AGENTS, SUBSIDIARIES OFFICERS, EMPLOYEES, PARTNERS AND LICENSORS MAKE NO WARRANT OR GRANT THAT (1) THE SERVICE WILL MEET YOUR REQUIREMENTS AND SATISFACTION, (2) THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, TIMELY, SECURE OR, (3) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE RELIABLE OR ACCURATE, (4) THE QUALITY OF ANY INFORMATION,MATERIAL, SERVICES OR OTHER PRODUCTS PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS OR SATISFACTION; AND (5) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

C. ANY MATERIAL DOWNLOADED PRINTED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY HARM ,LOSS, OR DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

D. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM, SETUPFAMILY.COM THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY OR GRANTY NOT EXPRESSLY STATED IN THE TOS.

E. FEW OR A SMALL PERCENTAGE OF USERS MAY EXPERIENCE EPILEPTIC SEIZURES OR FITS WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS ON A COMPUTER SCREEN OR WHILE USING THE SERVICE. CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE SERVICE.YOU SHOULD IMMEDIATELY DISCONTINUE USE OF THE SERVICE AND CONSULT YOUR PHYSICIAN, IF YOU EXPERIENCE ANY OF THE FOLLOWING SYMPTOMS WHILE USING THE SERVICE: DIZZINESS, ALTERED VISION, EYE OR MUSCLE TWITCHES, LOSS OF AWARENESS, HEADACKE, DISORIENTATION, ANY INVOLUNTARY MOVEMENT, OR CONVULSIONS.

19. LIMITATION OF LIABILITY:

YOU EXPRESSLY UNDERSTAND AND AGREE THAT SETUPFAMILY.COM AND ITS AFFILIATES, SUBSIDIARIES, AGENTS, OFFICERS, EMPLOYEES, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SETUPFAMILY.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (1) THE USE OR THE INABILITY TO USE THE SERVICE; (2) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS PRODUCTS, AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, PRODUCTS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (3) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (4) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (5) ANY OTHER MATTER RELATING TO THE SERVICE.

If you intend to join or create or any service, receive or request any news, messages, alerts or other information from the Service concerning companies, stock quotes, investments or securities, you acknowledge and agree that the Service is provided for informational purposes only, and no Content included in the Service is intended for trading or investing purposes. SETUPFAMILY.COM and its licensors shall not be responsible or liable for the usefulness, accuracy, and availability of any information transmitted or made available via the Service, and shall not be responsible or liable for any trading, or investment decisions based on such information.

20. Force Majeure.

SETUPFAMILY.COM, will not be responsible for any failure or delay in performance hereunder , that is directly or indirectly related to acts of god , storm ,natural disaster , act of terrorism , utility outages or interruptions , system transmission failure , server failure , lockout , or any other situation which is beyond its control.

21. NO THIRD-PARTY BENEFICIARIES

You agree that, except as otherwise expressly provided in this TOS, there shall be no third-party beneficiaries to this agreement.

SETUPFAMILY.COM may provide you with notices, including those regarding changes to the TOS, by email, regular mail or on the Service.

The SETUPFAMILY.COM, SETUPFAMILY.COM logo, SETUPFAMILY.COM (in all available world languages), ANY SETUPFAMILY.COM RELATED LOGO.ACCENTRIC, FOR ALL THAT SURFING YOU NEED THE RIGHT BOARD, FORTIFIED WITH SETUPFAMILY.COM, GEOCITIES, Geo Cities logo, GEOCITIES (in Chinese characters),and other SETUPFAMILY.COM logos and product and service names are trademarks of SETUPFAMILY.COM Comp. LTD. (the "SETUPFAMILY.COM Marks"). Without SETUPFAMILY.COM's prior permission, you agree not to display or use in any manner the SETUPFAMILY.COM Marks.

24. NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT

SETUPFAMILY.COM respects the intellectual property of others, and we ask our users to do the same. SETUPFAMILY.COM may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide SETUPFAMILY.COM's Copyright Agent the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the Copyright or other Intellectual property interest;

3. A description of where the material that you claim is infringing is located on the site.

4. Your address, telephone number, and email address;

25.Parital Invalidity.

Should any provision of this agreement be hold to be void , invalid or inoperative, the remaining provisions of this agreement shall not be affected and shall remain in effect and the invalid provision shall be deemed modified to the least degree necessary to remedy such invalidity.

26.Governing Law and Dispute Settlement.

In interpreting the terms of this agreement , the parties agree that the law of the United Kingdom shall be applicable . All suits shall be subject to the competence of the United kingdom jurisdiction.

27. GENERAL INFORMATION

v This TOS constitutes the entire agreement between you and SETUPFAMILY.COM and governs your use of the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other SETUPFAMILY.COM services, affiliate services, or third-party content.

v This TOS and the relationship between you and SETUPFAMILY.COM shall be governed by the laws of the United Kingdom without regard to its conflict of law provisions. You and SETUPFAMILY.COM agree to submit to the personal and exclusive jurisdiction of the courts located within the county of London, United Kingdom.

v The failure of SETUPFAMILY.COM to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

v You agree that your SETUPFAMILY.COM account is non-transferable and any rights to your SETUPFAMILY.COM ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

v You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

v The section titles in the TOS are for convenience only and have no legal or contractual effect.
